Participant Waiver, Release of Liability, Assumption of Risk, and Media Release
Please read carefully before signing. This document affects your legal rights.
1. Acknowledgment and Assumption of Risk
I understand that participation in the United Call Works River Run (“Event”) is voluntary and may involve inherent and unforeseen risks including, but not limited to:
- Boating and watercraft operation
- Weather, waves, current, and water conditions
- Drowning and water-related incidents
- Collision with vessels, docks, obstacles, vehicles, or other participants
- Personal injury, illness, disability, or death
- Property damage, theft, or loss
- Participation in raffles, games, contests, and event activities
- Travel to and from event locations by any method
- Decisions made by other participants
- Delayed emergency response
- Risks associated with being present at public establishments
I voluntarily choose to participate and knowingly assume all risks associated with participation.
2. Participant Responsibility
I acknowledge and agree that:
- I am solely responsible for operating my own boat, watercraft, vehicle, or other transportation.
- I am responsible for my own safety and the safety of all passengers accompanying me.
- I will comply with all applicable local, state, and federal laws including boating, traffic, and U.S. Coast Guard requirements.
- I represent that I am legally permitted and qualified to operate my vessel or vehicle.
- I will maintain all legally required registration, insurance, and safety equipment.
- I am participating voluntarily and am not acting as an employee, contractor, representative, or agent of United Call Works.
- Participation does not require travel by boat and participants may attend by any lawful transportation method.
- I am solely responsible for evaluating weather conditions, water conditions, equipment conditions, and my own abilities before participating.
3. Event Nature / No Supervision / No Transportation
I understand and agree that United Call Works is hosting a voluntary customer appreciation and promotional event.
United Call Works does not provide:
- Transportation
- Guides
- Route planning
- Boating instruction
- Watercraft rental
- Supervision
- Rescue services
- Security services
- Medical services
- Alcohol service
- Participant monitoring
Participants independently decide:
- Whether to participate
- When to travel
- How to travel
- What route to take
- Whether to stop at any location
United Call Works does not organize, direct, supervise, coordinate, or control participant travel between event locations. Attendance at any specific location is not required for participation.
4. Alcohol Responsibility
I understand event stops may include restaurants, bars, and businesses that independently sell alcohol.
United Call Works:
- Does not provide alcohol
- Does not monitor alcohol consumption
- Does not encourage alcohol use
- Does not supervise participants after alcohol consumption
Any alcohol consumed is independently purchased from licensed establishments and is not included with registration.
I agree:
- Not to operate a vessel, vehicle, or equipment while impaired.
- To comply with all boating and motor vehicle laws.
- That all decisions regarding alcohol consumption are my own responsibility.
5. Release of Liability
To the fullest extent permitted by law:
I release, waive, discharge, and hold harmless United Call Works, its owners, officers, employees, volunteers, sponsors, affiliates, contractors, event partners, vendors, and representatives from all claims, liabilities, damages, injuries, expenses, attorney fees, or causes of action arising out of or related to:
- Participation in the Event
- Travel to or from Event locations
- Actions of other participants
- Property damage
- Bodily injury
- Medical expenses
- Disability
- Death
This release includes claims arising from ordinary negligence to the fullest extent permitted under Ohio law but does not apply to gross negligence or intentional misconduct.
6. Indemnification
I agree to defend, indemnify, and hold harmless United Call Works from any claims, demands, lawsuits, damages, losses, or expenses resulting from:
- My conduct
- My passengers
- My transportation choices
- My actions during participation
7. Medical / Emergency Responsibility
I understand:
- United Call Works is not providing medical personnel.
- Emergency response times may vary.
- I am responsible for my own emergency preparedness.
- I am responsible for obtaining my own medical treatment and insurance.
I authorize emergency responders to provide emergency care if necessary and understand all costs remain my responsibility.
8. Fitness to Participate
I certify that:
- I am physically capable of participating.
- I am not participating under the influence of drugs or alcohol.
- I will stop participating if conditions become unsafe.
- I understand participation may involve physical and environmental risks.
9. No Duty to Rescue
I understand United Call Works has no obligation to:
- Monitor my location
- Verify my arrival
- Provide assistance
- Initiate rescue operations
- Coordinate emergency response
10. Media Release
I grant permission to United Call Works to photograph, video record, and use my image, likeness, voice, or recordings from the Event for advertising, promotional, website, social media, or marketing purposes without compensation.
11. Weather / Event Changes
I understand United Call Works may cancel, delay, shorten, modify, reroute, or postpone the Event due to weather, safety concerns, emergencies, or unforeseen circumstances. Registration fees and merchandise policies remain subject to Event rules.
12. Minors
If signing for a participant under age 18, I certify I am the parent/legal guardian and agree to these terms on behalf of the minor.
13. Severability
If any portion of this agreement is found unenforceable, all remaining provisions remain in full force and effect.
14. Governing Law
This agreement shall be governed and interpreted under the laws of the State of Ohio.
